Data Protection pursuant to the General Data Protection Regulation (GDPR) – Information for customers and suppliers of KHBoddin GmbH

We point out that KHBoddin GmbH uses electronic means and technologies to store and process personal data.

We have prepared this document to provide you with information on the processing of your personal data by us and your rights pertaining to the processing and use of your data.

The type and scope of data processed by our company varies and depends on the nature and scope of our business relationship with you.

2. What data do we use and how do we collect this data?

We process the following categories of data relating to our business partners and their contact persons for the purpose of initiating and performing our business relationship with you. We collect this data from you on the basis of your express declaration of consent.

We also process data lawfully obtained from publicly accessible sources, such as the commercial register, the internet or a credit insurance:

3. Purpose and legal basis of processing the data

Our company specialises on the trade with chemicals, starting materials and additives for pharmaceutical products, food products and animal feed, as well as all commercial and supporting services related to such products.

We process your data for purposes related to our business activities. Our data processing operations comply with the requirements of the General Data Protection Regulation, the Federal Data Protection Act (BDSG) and all other applicable laws and regulations (such as the Commercial Code).

 

4. Data processing for performing a contract or for pre-contractual measures

The processing of personal data predominantly serves the propose of performing orders or contracts between us and our customers, suppliers and service providers.

The processing may also serve the performance of pre-contractual measures required by our business partners.

We may in certain cases also process your data for purposes other than the performance of a contract. This may be the case if we are compelled to safeguard the legitimate interests of KHBoddin GmbH, a third party or in the public interest (i.e. under tax law or customs regulation).

 

5. Access to data

Within our company, access to your data is only granted to those who require data for the purposes set out above, or for the purpose of performing our order-specific or contractual obligations as well statutory duties. We may in this respect make the data available to subcontractors or vicarious agents engaged by us.

Data will only be disclosed to external parties and without a connection to any particular business transaction if disclosure is required by law or permissible on the basis of your declaration of consent.

All recipients of data are required to comply with the applicable data protection regulations.

This means that personal data may be disclosed to:

  • Public authorities and institutions (i.e. the tax office) if disclosure is required by law or on the basis of an official order
  • Contract data processors to whom we transmit personal data for a purpose relating to the performance of our business relationship with you (i.e. support/maintenance of IT systems, data destruction, payment processing, accounting, auditing, service provider)
  • Those recipients you have granted your consent for.

 

6. Period of data storage

We will process and store your personal data for as long as necessary to achieve the purposes set out in point 3. It must be noted that our business relationships are usually of a long-term nature.

Any data that is no longer necessary for the performance of contractual or statutory obligations will be deleted on a regular basis, unless their further processing is temporarily necessary for the following purposes:

  • Compliance with retention periods under commercial law or tax law, i.e. the German Commercial Code or the German Tax Code. The statutory retention periods range from 2 to 10 years.
  • Preservation of evidence under the statute of limitations (i.1. Section 195 ff of the German Civil Code).

All data subjects have the right to receive information about their data pursuant to Article 15 GDPR, the right to the correction of their data pursuant to Article 16 GDPR, the right to be forgotten pursuant to Article 17 GDPR, the right to restrict the processing of their data pursuant to Article 18 GDPR, the right to object pursuant to Article 21 GDPR and the right to data portability pursuant to Article 20 GDPR.

The right to receive information about data and the right to be forgotten are limited by the provisions of Sections 34 and 35 of the Federal Data Protection Act. Data subjects also have the right to lodge a complaint with the relevant supervisory authority (Article 77 GDPR i.c.w. Section 19 Federal Data Protection Act).

You may revoke a previously granted declaration of consent at any time. This also applies to the revocation of declarations of consent granted prior to the GDPR entering force, meaning before 25 May 2018. Please note that a revocation only has effect on the future. Any data processing operations carried out prior to the revocation will remain unaffected.

 

7. Obligation to disclose data

Our business relationship requires you to disclose the personal data that is necessary for the purpose of initiating and conducting your business relationship with our company and required for performing the associated contractual obligations. You are also required to disclose any data required under a statutory provision.

IP anonymization

On this website, we have activated the IP anonymization function. As a result, your IP address will be abbreviated by Google within the member states of the European Union or in other states that have ratified the Convention on the European Economic Area prior to its transmission to the United States. The full IP address will be transmitted to one of Google’s servers in the United States and abbreviated there only in exceptional cases.
